LEGAL NOTICE FOR BIDS Sealed bids will be received by the Director of Utilities and Income for the City of Defiance, Ohio for the trade in of 2, a 1996 and a 1998 Chevy Astro Vans for 2 new compact/mini vans until 1:30 P.M., LOCAL TIME, on TUESDAY, DECEMBER 8, 2009. All proposals for the Utility Billing Division shall be sealed and endorsed on the envelope: Utility Billing Bid For Vehicle 93, Or Utility Billing Bid For Vehicle 94, and mailed to The Utility Billing Office 324 Perry Street Defiance, Ohio 43512 or delivered to the Utility Billing Office 324 Perry Street , Defiance, Ohio. Bidders may submit a bid on either vehicle or both vehicles. Please note that these are separate bid proposals and must be submitted in separate envelopes. Bidders who wish to attend the bid opening may deliver their bids at the bid opening, provided that they are received by the City prior to the opening of the first bid. All bid proposals must be submitted on the proposal blanks furnished with the specifications. Each proposal must contain the full name of every person or company interested in same. Specification and bidding blanks may be obtained at the Utility Billing Office 324 Perry Street Defiance, Ohio 43512. Specifications will be sent as soon as possible after receipt of a request. Said bid proposals will be publicly opened and read at 2:00 P.M. for TWO (2) NEW Compact/ Mini Vans in the Front Conference Room located in the City Services Building, 631 Perry St., Defiance OH 43512. Each bid proposal must be accompanied by a bond with an approved Surety Company, in the sum of $500, as surety for the execution of the Purchase Agreement. A certified check on a solvent bank, drawn and made payable to The City of Defiance, Ohio in the sum of $500 will be accepted in lieu of said bond. Should any bid be rejected, such bond or certified check shall be returned to the bidder after proper execution of the contract by the successful bidder and, should any bid be accepted, such bond or certified check will be returned upon proper execution and securing of the Purchase Agreement and delivery of the vehicle. Should the successful bidder not be able to deliver the vehicle according to the proposal and within the allotted time of the date award of the contract is made, the bidder will forfeit the $500 surety. The City of Defiance, OH reserves the right to reject any and all bids, and to award to the Lowest Responsive and Responsible Bidder, and to waive any irregularities in bidding. Ordinance No. 7088 AN ORDINANCE AUTHORIZING THE AMENDMENT OF A CONTRACT WITH FIRSTENERGY SOLUTIONS CORPORATION PERTAINING TO THE SUPPLY OF ELECTRIC POWER TO AGGREGATED CONSUMERS WHEREAS, by Ordinance Adopted April 28, 2009, Council authorized the award of a contract to FirstEnergy Solutions Corporation to supply electricity to aggregated consumers; and, WHEREAS, FirstEnergy Solutions Corporation has proposed an amendment to the electricity supply contract that will extend the term of the agreement, presently scheduled to expire in May, 2012, through May, 2018; and, WHEREAS, municipal agreement to the proposed contract amendment will qualify the City of Defiance for participation in FirstEnergy Solutions' Powering Our Communities program pursuant to which FirstEnergy Solutions Corporation will award the municipality a one time grant in the amount of $182,861.00; and, WHEREAS, the proposed amendment does not otherwise alter the previously approved pricing formula or other terms and conditions of service and expressly preserves the ability of aggregated consumers to withdraw from the program; Now therefore, be it enacted by the Council of the Municipality of Defiance, Ohio, that: Section 1: The Third Amendment to the Master Agreement to Provide Services to an Aggregation Group Between Defiance, Ohio, and FirstEnergy Solutions Corporation now on file in the office of the City Law Director is approved and municipal officials are authorized to execute the same in their official capacities. Section 2: It is found and determined that all legislative actions pertaining to the adoption of this Ordinance were taken in Public Session and that all deliberations that affected or influenced any such legislative act, including all deliberations in Committee, were conducted in Public Session duly convened in accordance with law. Section 3: This Ordinance shall be effective on the earliest date permitted by law. Ordinance No. 7089 AN ORDINANCE AUTHORIZING THE CITY FINANCE DIRECTOR TO CONTRACT WITH JULIAN & GRUBE, INC., FOR THE PERFORMANCE OF PROFESSIONAL SERVICES WHEREAS, the municipality maintains financial records in accordance with generally accepted principles of cash-based accounting; and, WHEREAS, State and Federal regulations require the City's annual financial statements to be presented on an accrual basis in accordance with Generally Accepted Accounting Principles; and, WHEREAS, the city has traditionally engaged the services of an independent accounting firm to assist with the GAAP conversion; and, WHEREAS, Julian & Grube, Inc. has performed the required services in recent years pursuant to a multi-year contract that is scheduled to expire; and, WHEREAS, the Finance Director recommends extension of a three year contract to Julian & Grube, Inc.; Now therefore, be it enacted by the Council of the Municipality of Defiance, Ohio, that: Section 1: The Finance Director is authorized to enter into a contract with Julian & Grube, Inc., to perform accounting services necessary to the preparation of annual financial statements in accordance with Generally Accepted Accounting Principles for a period of three years at a cost of $10,100 per year. Section 2: It is found and determined that all legislative actions pertaining to the adoption of this Ordinance were taken in Public Session and that all deliberations that affected or influenced any such legislative act, including all deliberations in Committee, were conducted in Public Session duly convened in accordance with law. Section 3: This Ordinance shall be effective on the earliest date permitted by law. ORDINANCE NO. 7090 AN ORDINANCE VACATING THE WESTERLY 17.50 FEET OF WAYNE STREET ADJACENT TO PUBLIC SQUARE IN AND OF THE COUNTY ADDITION TO THE CITY OF DEFIANCE WHEREAS: The Board of County Commissioners has proposed significant improvements to the Defiance County Courthouse that include adaptive reuse of the adjacent public building originally constructed as the Sheriff's residence and jail; and, WHEREAS: A survey of the public lands occupied by said structures disclosed that the former Sheriff's residence and jail encroaches on the Wayne Street right-of-way; and, WHEREAS: The designed improvements anticipate enlargement of the former Sheriff's residence resulting in additional encroachment onto the Wayne Street right-of-way unless the right-of-way is narrowed by vacation or the development is redesigned; and, WHEREAS: Portions of the Wayne Street right-of-way north of Court Street were previously vacated to facilitate enlargement of County-occupied public buildings rendering future widening of Wayne Street between First and Second Streets impractical; and, WHEREAS: The Planning Commission has reviewed and approved the site plan for the Courthouse improvements as presently designed; and, WHEREAS: Council finds there is good cause for the vacation of the westerly 17.50 feet of Wayne Street between the points of intersection with Second Street and Court Street and further finds that the vacation will not be detrimental to the general interest; NOW THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF DEFIANCE, THAT: SECTION 1: The westerly 17.50 feet of the Wayne Street right-of-way between points of intersection with Second Street and Court Street, is hereby vacated subject to the reservation of permanent easements for any and all municipal and public utility facilities located within the vacated right-of-way in accordance with O.R.C. 723.041. SECTION 2: Municipal officials are authorized to execute the proposed Vacation Plat now on file in the office of the City Engineer and to cause the same to be Recorded. The City Administrator is directed to certify the amount of any costs actually incurred to prepare and record the approved Vacation Plat to the Finance Director. SECTION 3: The Finance Director is directed to pay all costs certified by the City Administrator from the deposit and to refund all deposited moneys in excess of the amount so certified to the Board of County Commissioners. SECTION 4: It is found and determined that all legislative acts pertaining or relating to the enactment of this Ordinance were taken in public session and that all deliberations of Council, including all deliberations of the committees of Council, that affected or influenced any such legislative act, were conducted in public session duly convened in conformity with law. SECTION 5: This Ordinance shall be effective on the earliest date permitted by law.
